End User License Agreement

• 1. Acknowledgement: This Agreement is between You and Pxlit Inc. only, and not with Apple, Inc. (“Apple”). Pxlit Inc., not Apple, is solely responsible for the Pxlit Application and the content thereof.
• 2. Scope of License: Pxlit Inc. grants You a personal, non-exclusive, non-transferable, and revocable license to use the App on any Apple-branded products You own or control.
• 3. License Tiers:
• 3.1 Starter Tier (Personal): Grants a license for private, non-commercial use. Video processing is performed locally on your hardware.
• 3.2 Paid Tier (Creator/Pro): Grants a license for commercial use, allowing You to use generated content for business marketing and promotional purposes.
• 4. Maintenance and Support: Pxlit Inc. is solely responsible for providing maintenance and support. Apple has no obligation to furnish support services for the App.
• 5. Warranty: Pxlit Inc. is responsible for product warranties. In the event of failure to conform to any applicable warranty, You may notify Apple for a refund of the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
• 6. Product Claims: Pxlit Inc., not Apple, is responsible for addressing any claims relating to the App, including product liability, legal/regulatory compliance, or consumer protection claims.
• 7. Intellectual Property Rights: In the event of a third-party claim of IP infringement, Pxlit Inc., not Apple, will be solely responsible for the investigation and defense.
• 8. Legal Compliance: You represent that (i) You are not in a country subject to a U.S. Government embargo; and (ii) You are not on any U.S. Government list of prohibited parties.
• 9. Governing Law: This Agreement is governed by the laws of the Commonwealth of Pennsylvania, USA. Any disputes shall be resolved via binding arbitration in Chester County, Pennsylvania.
• 10. Third-Party Beneficiary: You agree that Apple and its subsidiaries are third-party beneficiaries of this EULA and have the right to enforce this Agreement against You.

• 1. License Grant: Pxlit Inc. grants you a revocable license to use the Pxlit App for video editing on Android devices.
• 2. License Tiers:
• 2.1 Starter Tier: Restricted to Personal Use only.
• 2.2 Paid Tier (Creator/Pro): Includes a Commercial License for business and promotional content.
• 3. Processing & Hardware: You acknowledge that all processing is performed locally on your device. Performance and export quality are dependent on your device’s hardware capabilities.
• 4. Software Restrictions: You may not attempt to decompile, reverse-engineer, or derive the source code of the Pxlit software.
• 5. Data Deletion: You may request the deletion of your account and associated data at any time via the App settings or our website.
• 6. Governing Law: This agreement is governed by the laws of the Commonwealth of Pennsylvania. Venue for any disputes shall be Chester County, PA.
